The Willem Mengelberg Society is the data controller—within the meaning of the General Data Protection Regulation (GDPR)—for the personal data processed via this website.
2. What data do we process
2.1 Orders in the webshop
When you place an order in our webshop (books, CDs, and other products), we process:
– Name
– Billing and shipping address
– E-mail address
– Telephone number, if provided (this field is optional)
– Order and payment details (products ordered, order amount, date)
– Payment details required to process the payment via our payment provider, Mollie
2.2 Donations
For one-off and recurring donations, we refer you to the platform geef.nl, an external donation service. You enter your details (name, e-mail address, payment details) directly on geef.nl; that processing is subject to the geef.nl privacy statement. Geef.nl also offers the option to donate anonymously; in that case, we do not receive any personal data from you.
If you do not donate anonymously, we receive your name, e-mail address, and the donation amount from geef.nl, in accordance with the donation terms and conditions you agreed to on geef.nl. We use this data to process the donation and to thank you. Because we receive this data from geef.nl and process it further ourselves (in our own records), we act as a joint data controller for this purpose; consequently, this aspect is indeed covered by this privacy statement. [TO BE CONFIRMED – as a client of geef.nl, a data processing agreement should exist between the Willem Mengelberg Society and geef.nl (Geef B.V.); this has not yet been located or confirmed. Geef.nl does not respond to individual inquiries regarding this matter, so this is being handled through our client relationship/agreement with geef.nl directly.]
2.3 News flash / newsletter
If you sign up for our news flash (currently by sending your email address to info@willemmengelberg.nl), we process:
– Email address
We send the news flash via Mailchimp. Mailchimp is based in the United States and acts as a data processor for this mailing list. Mailchimp employs appropriate safeguards (standard contractual clauses) for the transfer of data to the US.
2.4 Contact form
If you contact us via the website, we process the data you enter yourself—typically your name, email address, and the content of your message.
2.5 Becoming a Friend/donor
Signing up as a “Friend (donor)” follows the same process as the donations described in section 2.2, via geef.nl.
2.6 Cookies and similar technologies
This website does not use tracking or analytics cookies (such as Google Analytics or Facebook Pixel). Only functional cookies necessary for the operation of the webshop are placed—for example, to remember the contents of your shopping cart during your visit. No consent is required for these functional cookies. 3. Purposes of data processing
We process your personal data for the following purposes:
– Processing and delivering your order
– Processing your payment
– Administering donations and sending acknowledgments
– Sending the newsletter, if you have subscribed to it
– Answering questions submitted via the contact form or by email
– Complying with legal (tax and accounting) obligations
4. Legal basis
We process your data based on:
– Performance of a contract: for orders in the webshop
– Consent: for sending the newsletter
– Legitimate interest: for handling inquiries and maintaining contact with donors
– Legal obligation: for retaining financial records
5. Retention periods
– Order and invoice data: 7 years, in accordance with statutory tax record-keeping requirements
– Newsletter email addresses: until you unsubscribe
– Contact form messages: up to 2 years after the last point of contact
6. Sharing with third parties
We only share your data with third parties to the extent necessary for the purposes mentioned above, including:
– Our hosting provider, Strato
– Our payment provider, Mollie
– Geef.nl, for processing donations (see section 2.2)
– Mailchimp, for sending the newsletter (see section 2.3)
Orders are shipped by the Willem Mengelberg Society itself; no external shipping provider is engaged to process your data for this purpose.
We never sell your data to third parties.
7. Your rights
Under the GDPR, you have the following rights regarding your personal data:
– Right of access
– Right to rectification
– Right to erasure (“right to be forgotten”)
– Right to restriction of processing
– Right to object
– Right to data portability
– Right to withdraw consent
You can exercise these rights by sending an email to info@willemmengelberg.nl. We will respond to your request within four weeks.
You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
8. Security
We take appropriate technical and organizational measures to protect your personal data against loss or unlawful use, including:
– The website is secured with an SSL certificate (HTTPS)
– Payment details are processed by Mollie; we do not store credit card or bank details ourselves
– Access to website administration (WordPress) is restricted to a small number of authorized persons
– Software and plugins (WordPress core, themes and plugins, PHP) are automatically updated
9. Minors
This website is not specifically aimed at collecting data from persons under the age of 16. If you suspect that we have collected data from a minor without consent, please contact us.
